RIDGEWOOD, NEW JERSEY… “FOUR
YEARS OF A LIVING HELL AT BANK OF AMERICA”.
On March 12, 2007 I started working at Ridgewood
office. One month later the Manager,
Mrs. Misha, informed me that she had received a package from Florida containing
negative information about me. The assistant manager from Florida as soon she
relocated the office where I was rehired sent documentation in revenge to
jeopardize my employment in New Jersey. She was aware of I finally took legal
action against the supermarket. I had to sue because it was the only way that
the bills were paid. The effects of this retaliation became my worst nightmare.
A month later, on my orientation, I discovered that my
position was a regular new teller with no seniority. I questioned the manager regarding my title,
which she responded that I was a regular teller because her office can’t afford
to hire me as senior teller. All my
benefits were reduced. Many times she threatened me with the information
received from Florida. She told me that
at any moment she might send it to the Personnel Dept but for now she would
keep the package in her office. On March 14, 2008 I worked until 6:10 pm (I
printed my sign off from the computer). When I completed my timesheet it went
over 40 hours. The manager asked me to
adjust it because she won’t pay me any overtime. I had to report a leaving time
by 2:00pm. Similar situation occurred on May 19, 2008 that also made me to
change the time of entry.
On October 04, 2007 I had a surgery on my knee. I stay at
home for six weeks.
January 19, 2008 I was caught sitting while servicing a
customer and I was reprimanded in front of everyone, this was very humiliating
to me.
After several plead to allowing me to sit since my
excruciating pain was unbearable, the manager agreed only if I asked the
customers if they don’t mind so. She warns me not to make it as a daily habit.
The manager makes me to close a big vault door without
having assistance from my coworkers. She singles me out to assist customers
with safe deposit boxes. Some of them were higher and needed the use of
stepladder; others were located at floor level and needed to bend the knees. My
co-workers voluntarily wished to serve those clients but the manager did not
allow it.
August 15, 2008, I had surgery on my left leg. It was hard
to keep my job with both legs operated. I had no consideration to my medical
conditions. The manager did her best to enforce the bank policy of not permit
tellers seating. This was her great opportunity to make my life a hell at Bank
of America.
My disability ended October 19, 2008. On September 05, 2008
I tried to have the advice of an attorney. I paid $ 300.00 for
consultation. I had written a letter to
be sent to the manager and the lawyer seemed well. He had changed few words and
told me that emailed to the manager without having him involved.
The manager’s answer was I abandoned my job. In consequence,
the lawyer told me he would need at least $ 10.000.00 in advance to start a
lawsuit.
I could not afford to have this money and he advised me not
even tried to apply for unemployment because it would be denied.
The bank sent information to the Unemployment office that I
voluntary leave the bank, this way I couldn’t collect the benefits. I presented
proofs that I was medical discriminated and forced to leave my job and the
unemployment benefits were granted.
RIDGEWOOD, NEW JERSEY… “CUATRO
AÑOS DE INFIERNO VIVIDOS EN BANCO DE
AMERICA”.
El 12 de marzo de
2007 comencé a trabajar en la oficina de Ridgewood. Un mes más tarde la gerente Sra. Laura Misha, me informó que había recibido un
paquete de Florida que contenía información negativa sobre mí. La subgerente de
Florida tan pronto se enteró de la oficina donde trabajaba aprovechó para
cobrar venganza y enviar documentación
que pusiera en peligro mi empleo en Nueva Jersey. Se dio cuenta que finalmente
había tomado acción legal contra el supermercado. Tuve que demandar porque era
la única manera que las cuentas médicas
fueran pagadas. Los efectos de esta represalia se convirtieron en mi peor
pesadilla. AÑOS
Un mes más tarde,
en mi orientación, descubrí que mi posición era un cajero nuevo regular sin
ninguna antigüedad. Cuestioné a la
gerente sobre mi título, y me respondió que era un cajero regular porque su
oficina no podía permitirse el lujo de contratarme como cajero antiguo. Todos los beneficios se redujeron.
Muchas veces me
amenazó con la información recibida de la Florida. Me decía que en cualquier momento la podría
enviar al Departamento de personal, pero por ahora mantendría el paquete en su
oficina
El 14 de marzo,
2008 trabajé hasta las 6:10 (imprimí mi salida en la computadora). Cuando hice
mi horario de tiempo trabajado pase de 40 horas. La gerente me pidió que quitara horas porque
ella no me pagaría tiempo extra. Me hizo
cambiar el tiempo de salida para las 2pm. Otra situación similar sucedió
el 19 de Mayo donde me hizo cambiar el tiempo de entrada.
El 04 de octubre
de 2007 tuve una cirugía en mi rodilla. Estuve en casa durante seis semanas. El
19 de Enero de 2008 la gerente se dio
cuenta que estaba sentada atendiendo un cliente. Para humillarme me reclamó
frente a todos y me hizo parar. Cuando el dolor de mi rodilla era insoportable,
le rogaba que me dejara sentar. Finalmente me permitió tener una silla pero con
la condición de pedirle permiso a cada cliente si podía sentarme. Además me
advirtió que no lo tomara como habito de hacerlo todos los días.
La maldad de esta
gerente llegó al punto que me obligaba a cerrar la puerta grande de la caja
fuerte. Algunos de mis compañeros intentaban ayudarme pero ella no lo permitía.
Su asistente también estaba pendiente de que lo hiciera sola.
Me hacia atender
los clientes que necesitaban su caja de seguridad. Algunas estaban ubicadas muy
alto y se requería escalera, otras a nivel del piso y tenía que doblar mis
rodillas. Mis compañeras de trabajo voluntariamente deseaban atender esos clientes pero la manager no lo
permitía.
El 15 de agosto
de 2008, tuve una cirugía en mi pierna izquierda. Fue difícil para mí mantener
mi trabajo con las dos piernas operadas y sin ninguna consideración para
sentarme. La gerente se empeñó hacer cumplir la política del Banco de no
permitir a los cajeros usar una silla. Esta fue su gran oportunidad de hacer mi vida un INFIERNO EN BANCO DE AMÉRICA.
El Banco envió información a la oficina de desempleo diciendo
que había dejado my trabajo voluntariamente y
así no poder recibir beneficios de desempleo. Presenté las pruebas de
discriminación médica y además que fui obligada a salir del banco, y los
beneficios de desempleo me fueron concedidos.
Mi discapacidad
terminaba el 19 de octubre de 2008. El 05 de septiembre de 2008 intenté tener el asesoramiento de un abogado.
Pagué $ 300,00 por una consulta. Había escrito una carta para enviarla a la
manager y el abogado le pareció bien. Le cambio unas palabras y me dijo que la
enviara por mi misma sin nombrarlo a él. La respuesta del gerente fue que había
abandonado el trabajo. En consecuencia, el abogado me dijo que necesitaría al
menos $ 10.000.00 por adelantado para iniciar una demanda. Como no podía
obtener ese dinero me dijo que no
intentara pedir beneficios de desempleo porque me iban a ser negados.
